Where the government has decided that a particular business in an industry shall become a privatization project, the requirements of the Competition Act may be compromised. For example, in the recent sale of the assets of The de Havilland Aircraft of Canada Limited from The Boeing Company to Bombardier Inc., the government's desire to complete the transaction resulted in a process which proceeded smoothly and efficiently from a Competition Act review standpoint.

Appointed Queen's Counsel in 1983 Mr. Baker has extensive experience in the area of business law, with emphasis on mergers and acquisitions, joint ventures, financing and structuring. He has acted for a number of public and private Canadian and multi-national clients, as general counsel or special counsel for specific projects, for example, the privatization of Terminals 1 and 2 at Lester B.
