Emily Unrau is a litigation associate with Branch MacMaster. She has a broad range of experience in civil litigation including insurance defence and class actions and has represented clients before the Provincial and Supreme Courts of British Columbia.

The court noted that since the class members were seeking to enforce shareholders’ rights that existed under Canadian securities law, the class members could obtain an indirect benefit by donating a portion of the settlement proceeds to an association that was dedicated to advancing investors’ rights. However, in the case at bar, if FAIR Canada was the cy pres recipient, then class counsel would also obtain an indirect benefit because they could take credit for the class members’ contribution to FAIR Canada, another client of the firm.
